TERMS OF SERVICE
The following are the terms and conditions for use of eRAMA pages on the Internet including without
limitation, the other services which may be offered from time to time by eRAMA for use with your Online
account password (each feature individually and collectively referred to as the "Service").
These Terms of Service set out the basis on which you agree to access and use the eRAMA Online service.
1. Customer Account, Password & Security
In order to use the Service, you must register and create a password as prompted at the Online Service Login
Page. (eRAMA customers must first register for the service by providing true, accurate and complete
information as prompted by the Registration Form). You are responsible for maintaining the confidentiality of
the password and account, and You are fully responsible for all activities that occur under your password or
account. You agree to immediately notify eRAMA of any unauthorized use of your password or account or any
other breach of security. eRAMA shall cannot and will not be liable for any loss or damage arising from your
failure to comply with this Section 1.0
2. Customer Privacy
It is eRAMA's policy to respect the privacy of its customers and take the issue of privacy seriously. eRAMA will
not monitor, edit, or disclose any personal information about you or your use of the Service, including its
contents, without your prior permission unless eRAMA in good faith has a good faith belief that such action is
necessary to: (1) conform to legal requirements or comply with legal process; (2) protect and defend the rights or
property of eRAMA; (3) enforce the Terms Of Service; or (4) act to protect the interests of its customers or
others.
You agree that eRAMA may access your account, including its contents, as stated above or to respond to service
or technical issues.
3. Modifications To Service
eRAMA reserves the right at any time and from time to time to modify or discontinue, temporarily or
permanently, the Service (or any part thereof) with or without notice given to You. You agree that eRAMA shall
not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.
4. Indemnification
You agree to indemnify and hold eRAMA, its parents, subsidiaries, affiliates, officers and employees, harmless
against all loss, costs, damages, expenses and from from any claim, demand, or liability or damage, including
reasonable legal fees, asserted by any third party due to or arising out of your use of or conduct on the Service
or arising from:-
a. .The use by You or any other person of this Service whether or not expressly authorized by you; or
b. any material posted on, transmitted or received via the Service; or
c. breach of any of these terms and conditions
5. Termination
These terms and conditions commence on the date which eRAMA first make available the Service to you and
continue until terminated according to these Terms of Service. You agree that eRAMA, in its sole discretion,
may suspend and/ or terminate your use or your access to any part or all of the Service, at any time, with or
without cause, with or without notice, effective immediately, for any reason whatsoever, including, without
limitation, for lack of use or if eRAMA believes that you have violated or acted inconsistently with the letter or
spirit of the Terms Of Service. eRAMA may also in its sole discretion and at any time discontinue providing the
Service, or any part thereof, with or without notice. You agree that any termination of your access to the Service
under any provision of this Terms Of Service may be effected without prior notice, and acknowledge and agree
that eRAMA may immediately deactivate or delete your account and all related information and files in your
account and/or bar any further access to such files or the Service. Further, you agree that eRAMA shall not be
liable to you or any third-party for any termination of your access to the Service. Suspension and/ or
termination of these Terms of Service by eRAMA for any reason whatsoever will be without prejudice to any
other rights, remedies or claims eRAMA may have against you under these Terms and Conditions or at law for
any of your prior breaches of any of these Terms of Service.
6. No Warranty
You expressly understand and agree that:
a) Your use of the service is at your own risk. The service is provided on an "as is" and "as available" basis. No
warranty of any kind, implied, express or statutory, including but not limited to the warranties of noninfringement
of third party rights, title, merchantability, fitness for a particular purpose and freedom from
computer virus, is given in conjunction with the service.
b) eRAMA makes no warranty that
1. the service will meet your requirements,
2. the service will be uninterrupted, timely, secure, or error-free,
3. the results that may be obtained from the use of the service will be accurate or reliable,
4. the quality of any products, services, information, or other material purchased or obtained by you
through the service will meet your expectations, and
5. any errors in the software will be corrected.
c) No advice or information, whether oral or written, obtained by you from eRAMA or through or from the
service shall create any warranty not expressly stated in the terms of service.
7. Limitation Of Liability
In no event will eRAMA be liable for any damages, including without limitation direct or indirect, special,
incidental, consequential or exemplary damages, losses or expenses arising in connection with the service or use
thereof or inability to use by any party, or in connection with any failure or performance, error, omission,
interruption, defect, delay in operation or transmission, computer virus or line or system failure, even if
eRAMA, or representatives thereof, are advised of the possibility of such damages, losses or expenses.
8. Submission
All information submitted to eRAMA via any Online Service forms or pages shall be deemed and remain the
property of eRAMA and eRAMA shall be free to use, for any purpose, any ideas, concepts, know-how or
techniques contained in information a customer provides eRAMA in the use of this Service. eRAMA shall not
be subject to any obligations of confidentiality regarding submitted information except as agreed by the eRAMA
entity having the direct customer relationship or as otherwise specifically agreed or required by law.
9. Changes To Subscription/Account Requested Via Online Service
All changes to your eRAMA service subscription/account made via online service forms/pages will be reflected
in the online service pages on the following working day. All information on your eRAMA service subscription/
account made available via online service will be correct as at the day preceeding the day of your check.
10. Copyright
Unless otherwise indicated, the copyright in this website and its contents, including but not limited to the text,
images, graphics, sound files, animation files, video files, and their arrangement, are the property of eRAMA, and
are protected by applicable Malaysian and international copyright laws. No part or parts of this website may be
modified, copied, distributed, retransmitted, broadcast, displayed, performed, reproduced, published, licensed,
transferred, sold or commercially dealt with in any manner without the express prior written consent of
eRAMA.
You also may not, without eRAMA expressed prior written consent, insert a link to this website on any other
website, frame or "mirror" any material contained on this website on any other server.
Any such unauthorised reproduction, retransmission or other copying or modification of any of the contents of
the eRAMA's website may be in breach of statutory or common law rights which could be the subject of legal
action.

These terms and conditions are governed by and are to be construed in accordance with the laws of Malaysia. By
accessing this website and/or using the services provided herein by eRAMA, you hereby consent to the exclusive
jurisdiction of the Malaysian courts in Kuala Lumpur, Malaysia in all disputes arising out of or relating to the use
of this website.
eRAMA makes no representation that the materials, information, functions and/or services provided on this
website are appropriate or available for use in jurisdictions other than Malaysia.
13. Miscellaneous
The failure of eRAMA to exercise or enforce any right or provision of these terms and conditions shall not
constitute a waiver of such right or provision.
If any part of these terms and conditions is determined to be invalid or unenforceable pursuant to applicable
law, then the invalid and unenforceable provision will be deemed superseded by a valid, enforceable provision
that most closely matches the intent of the original provision and the remainder of the other provisions of the
terms and conditions shall continue in full force and effect.
eRAMA reserves the right to amend these Terms and Conditions at any time without prior notice. You are
responsible to regularly reviewing information posted online to obtain notice of such amendment. Your
continued access into and usage of this Service after such amendments shall be construed as your having
accepted all such amendments.
These Terms and Conditions shall have effect only to the extent not forbidden by law. For the avoidance of
doubt, it is hereby agreed and declared in particular, but without limitation, that nothing herein shall be
construed as an attempt to contract out of any provisions of the Consumer Protection Act 1999, if and where
the said Act is applicable.
